CONDITIONS OF SALE
K.M.R. Photographic Services Ltd also Trading as Aquaphot
Note: - The customer is the person or Trading Company or any employee
of that company who requests the services of K.M.R. Photographic Services
Ltd. / Aquaphot
All retail prices quoted are inclusive of VAT.
K.M.R. Photographic Services Ltd. / Aquaphot is not responsible for films,
batteries or any accessories left in or with the equipment and are not
responsible for any expense loss or inconvenience caused.
Sales of new equipment are covered under the manufacturers warranty and
we will liase between the customer and manufacturer/importer to resolve
any problems within a reasonable timescale.
Sales of second-hand equipment are warranted for a period of three months
from the date of purchase to be free from defects under normal use.
Industrial and professional equipment is guaranteed for a period of 30
days unless otherwise stated.
We reserve the right to repair or replace with equivalent model without
recourse to the customer and as we deem necessary.
Repair work is warranted for a period of three months from the date of
repair to be free from defects under normal use.

As with any warranty there are restrictions and exclusions: -
Not covered are: - Damage caused by impact, battery corrosion, liquid
damage, equipment that has been tampered with, sand contamination or any
equipment that has been mishandled or the non-observance of operating
instructions, or unauthorized modification of repair.
Our obligation is limited to the repair of the same defect only, provided
this equipment is accompanied by proof of repair i.e. K.M.R. Photographic
Services Ltd. / Aquaphot reference number together with detailed defect
description. K.M.R. Photographic Services Ltd. / Aquaphot shall at its
sole discretion decide the nature of repair and the type of replacement
parts to be used. K.M.R. Photographic Services Ltd. / Aquaphot may sub
contract all or part of the repair work. K.M.R. Photographic Services
Ltd. / Aquaphot do not accept liability for consequential loss regardless
of work carried out.
Any dates indicated by K.M.R. Photographic Services Ltd. / Aquaphot for
completion of repair work or replacement are approximate only and we shall
not be liable for any loss whatsoever resulting from failure to meet such
dates.K.M.R. Photographic Services Ltd. / Aquaphot may postpone repair
work at any time.
If the equipment is returned un-repaired K.M.R. Photographic Services
Ltd. / Aquaphot shall endeavour to re-assemble the goods to the condition
in which they were received but shall not be liable for any loss or damage
whatsoever resulting from its failure to do so.
K.M.R. Photographic Services Ltd. / Aquaphot shall be under no obligation
to give the customer an estimate before commencing to repair the goods
unless the customer has formally requested an estimate in writing.
No estimate will be formulated for any work priced at £18.50 or under
(inc VAT), these repairs will automatically be proceeded without estimate.
If no authorization is received within 4 months of the estimate the equipment
will be returned and we reserve the right to charge for storage / insurance
cover and examination cost.
The estimate is subject to revision if the internal condition is not as
anticipated on first examination.
Any item/part supplied or fitted by K.M.R. Photographic Services Ltd.
/ Aquaphot remains the property of K.M.R. Photographic Services Ltd. /
Aquaphot until the invoice, including any outstanding amounts and any
interest therein has been paid in full. All trade accounts must be paid
within 30 days of date of invoice unless otherwise agreed in writing.
All non-account invoices must be paid within 14 days of date of invoice,
all outstanding accounts will accrue interest at 5% over Barclays Bank
PLC current base rate calculated on a daily basis.
K.M.R. Photographic Services Ltd. / Aquaphot reserves the right to recover
from the customer any costs incurred directly or indirectly in connection
with the collection of any outstanding balance of overdue accounts.
In the event that the customer commits any act or default which entitles
us to exercise any of our rights under the above conditions, we will have
the right to repossess and use the goods and for that purpose our agents
may enter upon any land or building, vehicle vessel or other place where
the goods are thought to be situated to recover our losses.
